Terms and Conditions
By placing an order with Web Design and Print Ltd, you confirm that you are in
agreement with and bound by the terms and conditions below.
Definitions
The Client : The company or individual requesting the services of Web Design and
Print Ltd.
Web Design and Print Ltd: The partners, their employees or appointed agents.
General
Web Design and Print Ltd will carry out work only where a written purchase order is
provided either by mail, fax or in person.
Web Design and Print Ltd will carry out work only for clients who are 18 years of
age or above.
Database, Application and E-Commerce Development
Web Design and Print Ltd, cannot take responsibility for any losses incurred by the
use of any software created for the client. Whilst every care has been taken to
ensure products are problem free and accurate, the ultimate responsibility lies
with the client in ensuring that all software is functioning correctly before
use. Any scripts, cgi applications or software (unless specifically agreed)
written by Web Design and Print Ltd, remain the copyright of Web Design and
Print Ltd
and may only be commercially reproduced or resold with the permission of Web
Design and Print Ltd.
Where applications or sites are developed on servers not provided by Web Design
and Print Ltd, the client is expected to provide or seek any information, additional
software, support or co-operation pertaining to the server required in order for
the application to be correctly developed. Where large applications are to be
developed, it is the clients responsibility to provide a suitable testing
environment which is identical to the final production environment.
The client is expected to test fully any application or programming relating to
a site developed by Web Design and Print Ltd, before being made generally available
for use. Where "bugs", errors or other issues are found after the site is live,
Web Design and Print Ltd will endeavour (but is not obliged to) to correct these
issues to meet the standards of function outlined in the brief.
Website Design
Whilst every endeavour will be made to ensure that the website and any scripts
or programs are free of errors, Web Design and Print Ltd cannot accept
responsibility for any losses incurred due to malfunction, the website or any
part of it.
Web Design and Print Ltd cannot take responsibility for any copyright infringements
caused by materials submitted by the client. We reserve the right to refuse any
material of a copyrighted nature unless adequate proof is given of permission to
use such material. The website, graphics or programming code remain the property
of Web Design and Print Ltd until all outstanding accounts are paid in full. Any
scripts, cgi applications or software (unless specifically agreed) written by
Web Design and Print Ltd remain the copyright of Web Design and Print Ltd and may only
be commercially reproduced or resold with the permission of Web Design and
Print Ltd.
Any additions to the brief will be carried out at the discretion of Web Design
and Print Ltd, and where no charge is made by Web Design and Print Ltd for such
additions, Web Design and Print Ltd accept no responsibility to ensure such
additions are error free and reserve the right to charge an according amount for
any correction to these or further additions.
The client agrees to make available as soon as is reasonably possible to Web
Design and Print Ltd, all materials required to complete the project to the agreed
standard and within the set deadline. Web Design and Print Ltd, will not be liable
for costs incurred, compensation or loss of earnings due to the failure to meet
agreed deadlines.
Web Design and Print Ltd, will not be liable for any costs incurred, compensation or
loss of earnings due to the work carried out on behalf of the client or any of
the clients appointed agents.
Web Design and Print Ltd, will not be liable for any costs incurred, compensation or
loss of earnings due to the unavailability of the site, its servers, software or
any material provided by its agents.
Compatibility
Web Design and Print Ltd will endeavour to ensure that any developed/designed site
or application will function correctly on the server it is initially installed
in and that it will function correctly when viewed with the majority of the web
browsing software. Web Design and Print Ltd can offer no guarantees of correct
function with browser software.
Payment of Accounts
A deposit will be required from a new client before any work is carried out. In
all cases, any costs incurred by Web Design and Print Ltd on behalf of the client
are payable in advance and are non-refundable. It is the Web Design and Print
Ltd
policy that any outstanding accounts for work carried out by Web Design and
Print Ltd or its affiliates are required to be paid in full, before your web site is
complete.
UK Domain Registration
Web Design and Print Ltd will accept all new registrations onto our system and
register them as soon as possible after payment has been processed. However
until the domain is showing as registered to the Customer via a WHOIS search we
do not guarantee a domain has been secured for a customer.
The domain name registration period runs for One or Two years,( or: depending
upon how many years the customer wishes to register the Domain Name) from the
date of registration. After this time period has lapsed registration renewal may
be made upon receipt of payment of renewal fees.
Once a registration request has been completed no refunds can be made by Web
Design and Print Ltd . No refunds can be made if registration attempts have been
made by the registrant within 48 hours of attempting to register the domain
through Web Design and Print Ltd.
Until the registrant receives confirmation of registration from Web Design and
Print Ltd, there is no guarantee that the domain name requested will be registered.
The registrant agrees that all details submitted in respect of a domain name
registration are true and correct. The registrant makes certain to Web Design
and Print Ltd that the registration of a domain name and the way in which it is used
(directly or indirectly) does not infringe the legal rights of any third party.
Web Design and Print Ltd do not accept any responsibility for the use of registered
domain names especially where there may be conflict over rights to ownership.
The registrant indemnifies Web Design and Print Ltd from any legal proceedings and
costs that arise as a result of the registration of a domain name.
Server use
Web Design and Print Ltd do not allow any of the following content to be stored on
its servers: Illegal Material - This includes copyrighted works, commercial
audio, video, or music files, and any material in violation of any UK
legislation. Adult Material - Includes all pornography, erotic images, or
otherwise lewd or obscene content. The designation of "adult material" is left
entirely to the discretion of Web Design and Print Ltd - Includes pirated software,
ROMS, emulators, phreaking, hacking, password cracking, IP spoofing, etc., and
encrypting of any of the above. Also includes any sites which provide "links to"
or "how to" information about such material.
Unlimited use policy
High bandwidth usage: Web Design and Print Ltd offers an unlimited use policy by
maintaining very large ratios of bandwidth per customer. In rare cases, Web
Design and Print Ltd may find a customer to be using server resources to such an
extent that he or she may jeopardize server performance and resources for other
customers. In such instances, Web Design and Print Ltd reserves the right to impose
the High Resource User Policy for the consideration of all customers. High
resource use policy
Resources are defined as bandwidth, processor utilization or disk space. Web
Design and Print Ltd may implement the following policy to its sole discretion:
When a website is found to be monopolising the resources available Web Design
and Print Ltd reserves the right to suspend that site immediately. This policy is
only implemented in extreme circumstances and is intended to prevent the misuse
of our servers. Customers may be offered an option whereby Web Design and Print
Ltd
continues hosting the website for an additional fee. Indemnification
Customer agrees that it shall defend, indemnify, save and hold Web Design and
Print Ltd harmless from any and all demands, liabilities, losses, costs and claims,
including reasonable attorney's fees asserted against Web Design and Print
Ltd, its
agents, its customers, officers and employees, that may arise or result from any
service provided or performed or agreed to be performed or any product sold by
customer, its agents, employees or assigns. Customer agrees to defend, indemnify
and hold harmless Web Design and Print Ltd against liabilities arising out of; (1)
any injury to person or property caused by any products sold or otherwise
distributed in connection with Web Design and Print Ltd server; (2) any material
supplied by customer infringing or allegedly infringing on the proprietary
rights of a third party; (3) copyright infringement and (4) any defective
products sold to customer from Web Design and Print Ltd server. Disclaimer
Web Design and Print Ltd will not be responsible for any damages your business may
suffer. Web Design and Print Ltd makes no warranties of any kind, expressed or
implied for services we provide. Web Design and Print Ltd does not back up your
data/website unless it is placed on a load balanced server, and whilst every
attempt would be made in the unlikely event of any corruption or hardware
failure, Web Design and Print Ltd cannot guarantee to be able to replace lost data.
Web Design and Print Ltd disclaims any warranty or merchantability or fitness for a
particular purpose. This includes loss of data resulting from delays, non
deliveries, wrong delivery, and any and all service interruptions caused by Web
Design and Print Ltd and its employees. Web Design and Print Ltd reserves the right to
revise its policies at any time.
